These terms cover your use of Abigail, an AI phone answering service operated by Ashesh Dhakal as a sole proprietor. By using the service you agree to them.
The service
Abigail answers calls to a phone number you point at us, speaks with your callers, captures details, and sends you summaries and alerts. Abigail is software, not a person, and is not a substitute for emergency services. Never route emergency calls through Abigail.
Your responsibilities
- You control the number you forward and confirm you are entitled to forward it.
- You are responsible for what you tell Abigail to say to your callers.
- You will not use Abigail for unlawful, deceptive, or abusive purposes, and you will comply with call recording and privacy laws in the places you and your callers are.
SMS terms
Program name. Abigail account and setup messages.
What you receive. Your account setup link, alerts when Abigail answers a call you missed, short summaries of calls Abigail took for you, and account, billing, and service notifications. We do not send marketing or promotional texts.
Message frequency. Message frequency varies and depends on your call volume and the alert settings you choose.
Cost. Message and data rates may apply.
Opting out. Reply STOP to any message to stop all messages. You will receive one confirmation and nothing after that.
Help. Reply HELP for help, or contact support@callabigail.com.
Carriers. Carriers are not liable for delayed or undelivered messages.
Fees
Paid plans are billed in advance on the interval shown when you sign up. You can cancel at any time and your plan runs to the end of the period you have paid for.
Availability
We work to keep Abigail running, but the service depends on telephone carriers and other providers and may be interrupted. We do not guarantee uninterrupted service.
Your data
Call transcripts, summaries, and customer details captured on your behalf belong to you. We process them to run the service, as described in our Privacy Policy. You can export or delete them at any time.
Liability
To the extent the law allows, Abigail is provided as is, and our total liability for any claim is limited to the fees you paid us in the three months before the claim arose. We are not liable for indirect or consequential losses, including missed business.
Ending the agreement
You can stop using Abigail at any time. We may suspend or end an account that breaks these terms or that puts the service or its other users at risk.
Governing law
These terms are governed by the laws of the Province of Manitoba and the federal laws of Canada that apply there.
